1. INTRODUCTION & ACCEPTANCE OF TERMS Welcome to FlapTrip. These Terms of Service ("Terms") govern your access to and use of the FlapTrip mobile application (the "App") and our website at flaptrip.app (collectively, the "Service"). The Service is operated by Anastasiia Vershinina PR Beograd ("Company," "we," "us," or "our").
PLEASE READ THESE TERMS CAREFULLY. By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not use the Service.
2. ACCOUNT REGISTRATION & ELIGIBILITY
Eligibility: You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are of legal age and have the right, authority, and capacity to enter into this agreement.
Account Security: You are solely responsible for maintaining the confidentiality of your account credentials (including the third-party authentication methods used to access your account, such as Apple or Google) and for all activities that occur under your account.
Communications: By creating an account, you consent to receive administrative, technical, and promotional communications from us via email or push notifications. You may opt out of promotional communications at any time.
3. SUBSCRIPTIONS, BILLING & CANCELLATION
In-App Purchases: Certain features of the App are available only through a paid subscription. Subscriptions are processed and billed entirely through third-party platforms (Apple App Store or Google Play Store).
Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You may manage and cancel your subscription at any time through your device's account settings (Apple ID or Google Account). Deleting the FlapTrip App from your device does not cancel your subscription.
Price Changes: We reserve the right to modify subscription prices at any time. Any price changes will apply to future billing cycles, and you will be notified in advance in accordance with Apple or Google policies.
4. REFUND POLICY Except when required by applicable law, all purchases and subscription payments are final and non-refundable. Because all transactions are processed through the Apple App Store or Google Play Store, we do not have the ability to process refunds directly. Any requests for refunds must be submitted directly to Apple or Google and are subject to their respective refund policies.
5. AI & TRAVEL SERVICES DISCLAIMER
AI-Generated Content: FlapTrip utilizes artificial intelligence, including third-party Large Language Models (LLMs), to generate travel itineraries and recommendations. While we strive to provide helpful suggestions, AI-generated content may contain errors, inaccuracies, or outdated information ("hallucinations").
Not a Travel Agency: FlapTrip is a technology platform, not a travel agency or tour operator. We do not provide, own, or control any of the travel services, flights, accommodations, or restaurants suggested in the App.
User Responsibility: You acknowledge that the itineraries are provided for informational purposes only. You are strictly responsible for independently verifying all details, including but not limited to: operating hours, prices, safety conditions, visa requirements, and availability. You are solely responsible for making your own bookings.
Assumption of Risk: Travel involves inherent risks. We disclaim all liability for any loss, damage, injury, delayed flights, closed venues, or ruined trips resulting from your reliance on the Service.
6. USER CONTENT & APP OUTPUT
User Input: You retain all rights to the information and preferences you provide to the App (e.g., destinations, budget, interests). You grant us a license to use this data to generate your itineraries and improve the Service.
App Output: We grant you a personal, non-exclusive, non-transferable license to use the itineraries generated by the App for your personal, non-commercial travel planning.
QR Code Sharing: If you choose to share a trip itinerary using the App's QR code feature, you acknowledge that the structure, locations, and details of that trip will become accessible to any user who scans the code. You are solely responsible for ensuring you do not include sensitive personal information in shared trips.
7. ACCEPTABLE USE POLICY You agree to use the Service only for lawful purposes. You strictly agree NOT to:
Use the Service in any way that violates any applicable local, national, or international law.
Reverse engineer, decompile, or disassemble any part of the App.
Use automated scripts, bots, spiders, or scrapers to access, copy, or extract data from the Service.
Attempt to bypass any paywalls, security features, or artificial intelligence rate limits.
Upload or generate content that is offensive, unlawful, defamatory, or infringes on the intellectual property rights of others.
Use the Service to build a competitive product or for commercial purposes without our express written consent.
8. FEEDBACK & SUBMISSIONS We welcome your feedback, bug reports, and suggestions for improving the Service ("Feedback"). By submitting Feedback, you agree that your disclosure is gratuitous, unsolicited, and without restriction. We are free to use, disclose, reproduce, or modify the Feedback without any additional compensation or obligation to you. You acknowledge that we may have similar ideas currently under development.
9. INTELLECTUAL PROPERTY RIGHTS
Our Property: The Service, including its original content, features, functionality, design, algorithms, and source code, is and will remain the exclusive property of Anastasiia Vershinina PR Beograd and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App for your personal, non-commercial purposes, strictly in accordance with these Terms.
10. THIRD-PARTY LINKS & SERVICES The App may contain links to third-party websites, booking platforms, or services (e.g., map services, restaurants, or hotels) that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of such third-party services.
11. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
"AS IS" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the Service, the accuracy of the AI-generated itineraries, or the security of your data. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses.
Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Anastasiia Vershinina PR Beograd, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising out of your use or inability to use the Service.
Liability Cap: In no event shall our total liability to you for all damages exceed the amount you paid to us for the Service during the twelve (12) months strictly preceding the claim, or fifty US dollars ($50), whichever is greater.
12. APP STORE & GOOGLE PLAY PROVISIONS If you download the App from the Apple App Store or Google Play Store, you acknowledge that these Terms are between you and us only, not with Apple Inc. or Google LLC.
We, not Apple or Google, are solely responsible for the App and its content.
Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Apple and Google are not responsible for addressing any claims by you relating to the App, including product liability claims or consumer protection claims.
You acknowledge and agree that Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms, and they will have the right to enforce these Terms against you.
13. TERMINATION We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service and delete your account via the App settings. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
14. GOVERNING LAW & DISPUTE RESOLUTION These Terms shall be governed and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Belgrade, Serbia, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
15. WAIVER & SEVERABILITY Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
16. CHANGES TO TERMS We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
